1. NO REPRESENTATIONS OR WARRANTIES

Vlad Zablotskyy Interpreting LLC will use its best efforts to provide an acceptable interpreting and/or translation but makes NO REPRESENTATIONS, WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, as to the accuracy of any translation or that it will be acceptable for the purpose(s) for which the translation is sought or used. The reader understands and assumes all responsibility for any damages, costs, loss or expense, of whatever kind, as a result of reliance on the translation provided.

2. LIMITATION OF LIABILITY FOR INTERPRETING ADN/OR TRANSLATION SERVICE

IN NO EVENT WILL Vlad Zablotskyy Interpreting LLC BE LIABLE FOR (I) ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, FEES, COSTS, EXPENSES AND THE LIKE) ARISING OUT OF THE TRANSLATION SERVICE OF OR INABILITY TO USE THE SERVICE, OR ANY INFORMATION, OR TRANSLATIONS PROVIDED BY THE SERVICE, OR DOWNLOADED FROM THE SERVICE, OR ANY DELAY OF SUCH INFORMATION OR SERVICE. EVEN IF Vlad Zablotskyy Interpreting LLC OR ITS AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SERVICE AND/OR MATERIALS OR INFORMATION RECEIVED THROUGH THE SERVICE. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, Vlad Zablotskyy Interpreting LLC LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

3. INDEMNIFICATION & LIABILITY FOR COURT COSTS

If any suit or legal action is brought against Vlad Zablotskyy Interpreting LLC in connection with translation services rendered, you agree to indemnify, defend and hold harmless Vlad Zablotskyy Interpreting LLC, its officers, directors, employees, agents, licensors, suppliers against all losses, expenses, damages, fees and costs, including court costs and reasonable attorneys’ fees, incurred by Vlad Zablotskyy Interpreting LLC in successful defense of such action. Venue for any such action shall be in Ocean County, New Jersey.
